Welcome to Little Swaps! By accessing or using our mobile application, you agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully, as they govern your use of our services, including buying and selling items on our marketplace. If you do not agree with these Terms, please refrain from using our app.

  1. Introduction
    Little Swaps (“we,” “us,” “our”) provides a platform that allows registered users to buy and sell new and secondhand kids’ items, including clothing, toys, and furniture. These Terms apply to all users and govern access and activities on the platform. Little Swaps is based in New York.

  2. Eligibility
    Users must be at least 18 years old to create an account and use the platform. By using Little Swaps, you represent that you meet this age requirement and have the legal authority to enter into this agreement. Users are responsible for all activity that occurs under their account.

  3. Account Creation & Management

    • Account Registration: To use the app, you must create an account and provide accurate, complete, and current information.

    • Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you suspect unauthorized use, please notify us immediately.

    • Account Responsibility: Users are responsible for the legality, accuracy, and quality of items listed, as well as for complying with any applicable laws.

  4. Prohibited Conduct
    Users must not:

    • Use the platform for unlawful purposes or post any illegal, fraudulent, or misleading content.

    • Misrepresent items for sale or infringe upon others' rights, including intellectual property rights.

    • Engage in disruptive or abusive behavior, including spamming, harassment, or posting offensive content.

    • Attempt to access another user's account or interfere with the platform’s security.

    • Violation of these terms may result in account suspension or termination.

  5. Listing Guidelines & Item Standards
    To maintain quality and safety, please adhere to the following guidelines:

    • Condition: Items must be in gently used, like-new, or new condition—no stains, rips, heavy wear, missing parts, or damage. Everything should be clean and ready for another family to love.

      • New With Tags: Your item has never been worn and the original hanging tags are still on. For this option, you’ll need to take pictures of the retail tags."

      • Like New: Your item has never been worn (other than perhaps trying it on), but the tags have been removed. There are no quirks or issues whatsoever.

      • Used - In good condition: Your item has only been lightly used and has been extremely well maintained. There may be some small signs of wear, but nothing major.

      • Used - But Plenty Of Life Left: Item shows noticeable signs of wear but despite its imperfections, it remains functional and wearable, offering substantial use to its next owner. All flaws should be clearly described and photographed to ensure transparency.

    • Quality: We do not accept fast fashion or low-quality items that don’t last. This includes brands like Shein, Temu, and similar ultra-fast fashion labels. Some retailers, like Target, sell both well-made and low-quality items—only durable, high-quality pieces should be listed.

    • Safety: Items that contain harmful chemicals, recalled products, or anything known to be toxic for children are prohibited. Parents are responsible for checking product safety before listing. For more details, visit the Consumer Product Safety Commission (CPSC) website.

    • Toys & Gear: We accept toys, baby gear, and other children’s essentials—as long as they are in great condition and fully functional. All pieces must be included, and items must meet safety standards. Recalled items are not permitted.

    • Listing Details: All listings must include clear, accurate photos and descriptions. Everything must be clean and in good shape—no heavily worn or damaged items. Pricing should reflect quality and condition (New with tags, Like New, Used in good condition, Used but plenty of life left).

    • Seasonal Items: You can list items year-round, no matter the season. If it’s in great condition, it’s welcome on Little Swaps!

  6. Buying & Selling

    • Listings: Users can post items for sale with a clear description, condition, and price. Items must be accurately represented.

    • Purchases: When purchasing an item, buyers agree to pay the listed price and any applicable fees. Payments are made through the platform’s secure payment processor.

    • Shipping:

      • Sellers are required to ship items within 3 days of purchase and buyers should review shipping terms provided by sellers.

      • If a seller fails to ship within this timeframe, buyers may cancel the order and receive a full refund by contacting support@littleswaps.com. If no cancellation request is made, the order will remain active.

    • Disputes & Returns:

      • Disputes between users are primarily their responsibility to resolve.

      • In cases of fraud or misrepresentation, Little Swaps may investigate and take appropriate actions but is not liable for resolving disputes.

  7. Fees and Payment Terms

    • Transaction Fees: We may charge a transaction fee or commission for each sale, which will be communicated to users in advance.

    • Refunds: Transaction fees are non-refundable unless otherwise specified by us. Refunds for item purchases are subject to seller policies and the outcome of any dispute resolution.

  8. Content Ownership and License

    • User Content: Users retain ownership of content they post on the platform but grant Little Swaps a non-exclusive, royalty-free license to use, display, and share this content as necessary for platform operation.

    • Intellectual Property: All intellectual property within the app is owned by Little Swaps or its licensors. Users are prohibited from copying, modifying, or using our intellectual property without permission.

  9. Liability Limitation
    To the fullest extent permitted by law, Little Swaps is not liable for any damages arising from user interactions, the sale or purchase of items, or the quality of items listed. We are not responsible for ensuring the accuracy, legality, or safety of items posted by users.

  10. Termination & Suspension

    • Account Suspension or Termination: We reserve the right to suspend or terminate accounts that violate these Terms, misuse the platform, or harm the community.

    • User-Initiated Termination: Users may request account termination at any time by contacting support.

    • Upon termination, user access to account information, past transactions, and listings may be restricted.

  11. Governing Law and Dispute Resolution

    • Governing Law: These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.

    • Dispute Resolution: Users agree to first attempt to resolve any issues with Little Swaps through our customer support. If unresolved, disputes will be subject to the exclusive jurisdiction of the state and federal courts located in New York.

  12. Modifications to Terms
    We may update these Terms from time to time. Changes will be effective upon posting, and continued use of the platform constitutes acceptance of the updated Terms.
